Content License

1. Purpose

Zektyc is a set of personal projects (website, Discord bot, ZMap application, Zenyth browser, etc.) published and made available to the public. This document governs the rights to use all content produced by Zektyc, with a view to protecting its author from any unauthorized reproduction, in whatever form, including through a copy of the website, a partial copy, or a git repository (Forgejo or otherwise).

This license is a bespoke "home" license: it does not equate to any known free or open license (MIT, Apache, CC-BY, GPL…). All rights not expressly granted by this document are reserved.

2. Rights holder and scope of rights

The author is the sole holder of copyright and personality rights over the covered content. Under the French Code de la propriété intellectuelle (in particular Articles L.111-1, L.121-1 and L.122-4), protection applies without any formality, from the moment of creation, whether or not the content is published, registered or identifiable.

The following are covered, without being exhaustive:

• editorial content: texts, blog posts, pages, documentation, answers, messages;
• visual identity: logo, icons, favicon, fonts, colors, graphic charter, screenshots;
• source code, HTML structure, CSS, JavaScript, configuration, data and scripts, whether or not visible in a git repository;
• illustrations, photographs and any other element subject to copyright.

3. Prohibitions

Unless prior written authorization is given by the author, it is prohibited to:

• reproduce, copy or duplicate, in whole or in part, any content, text, blog post, page or page structure;
• republish, distribute, post online or otherwise share content, including on another website, a social network, a forum, a newsletter or any other medium;
• reuse, adapt, translate, modify, transform or create derivative works (including direct, recognizable "inspiration" from the structure or the texts);
• use the logo, icons or visual identity in any way whatsoever;
• copy, duplicate or host the website in whole or in substantially identical form, including through aggregation, heavy scraping or duplication of the git repository;
• remove, hide or alter original copyright notices, credits or metadata.

Merely following links, viewing pages in a browser or keeping a technically necessary cache copy for browsing does not constitute reproduction within the meaning of this license.

4. Source code hosted on Forgejo

The source code is made available in a git repository (Forgejo) for consultation, audit and verification purposes only. Access to the repository does not constitute a license, nor an authorization to use, copy, modify or redistribute. In particular:

• it is prohibited to clone, fork, download or distribute the repository, in whole or in part, except for occasional consultation;
• it is prohibited to extract, reuse or adapt any part of the code, algorithms or data for another project, including a personal or free-software project;
• a third-party hosting repository reproducing this code (mirror, public fork) constitutes infringement and will be reported and removed.

5. Permission requests

Any reproduction, extended quotation, reuse or collaboration must be subject to a prior written request to the author, by email to riric65@protonmail.com, stating the extract or element concerned and the intended use. Any permission granted is always express, written, personal and revocable; it never extends to any other use than the one authorized.

6. Right to demand removal (takedown)

If content covered by this license is reproduced, copied or distributed without authorization, the author is entitled to demand its removal and cessation:

• directly from the person or entity responsible for the reproduction (letter, email, cease-and-desist);
• from any host, platform, provider or git registry concerned (including Forgejo instances), by the reporting mechanism and official takedown procedure provided by the platform concerned;
• by any other means consistent with the terms of use of the platform concerned.

In practice, each platform or host imposes its own formalities for content removal (DMCA or notice-and-takedown procedure, dedicated form, required information about the claimant and the rights invoked…). This document does not replace those procedures, and does not relieve the author of the obligation to comply with the formalities they impose: it is useful to support a takedown request (by establishing ownership of the rights and the rights holder's contact details), but it does not in itself constitute a notice within the meaning of Article L.512-1 of the French Code de la propriété intellectuelle to such third parties. In any event, the author may at any time revoke public access to the original git repository.

7. Legal exceptions

Nothing in this license restricts the legal exceptions to copyright provided for by the French Code de la propriété intellectuelle (Article L.122-5): short quotations with clear indication of the source and the author, private representation within the family circle, private copy exception, etc. These exceptions apply only to their strict legal scope and may not be interpreted as a general authorization.

8. Sanctions

Any unauthorized reproduction constitutes infringement, a civil and criminal offense (Articles L.335-2 et seq. of the French Code de la propriété intellectuelle). The rights holder may, without prejudice to damages, have the infringement stopped by any legal means, including interim relief proceedings, and may seek the surrender and removal of the infringing copies.
